Terms and Conditions of Use of the TNOS Application

 

The following explains the Service Usage Agreement between the User (You), as the party using the TNOS Application service, and PT. Xtreme Network Sistem (Us), as the owner of the TNOS Application service, which contains the terms and conditions of use of the TNOS Application that apply to you to be able to use it.


Please read this Agreement carefully. You must read, understand, accept, and agree to all the terms and conditions in this Agreement before using the application and/or using the content contained therein.


By using the application and/or accessing the TNOS Application, you agree to all the terms and conditions contained therein. The TNOS Application is this application that you download so that you enter this page or these terms and conditions, which are currently known as the brand, logo, and/or sign, and by the name TNOS.


You understand and agree that these Terms of Use are an electronic agreement, and if you press the "register" button when opening an account or the "login" button when accessing your account, it is your active agreement to be bound by an agreement with us so that the validity of these Terms of Use and the Privacy Policy are valid and legally binding and continue to apply throughout your use of the TNOS Application and its services. If you do not accept and agree to any part or all of the contents of the terms and conditions in this Agreement, you are not permitted to access further.

 

 

DEFINITION

 

  1. PT. Xtreme Network Sistem is a limited liability company that owns the TNOS and Tnosworld brands, legally established and operating under the laws of the Republic of Indonesia, and domiciled in the Special Capital Region of Jakarta, Indonesia. PT. Xtreme Network Sistem is a software technology company that provides online service applications to connect Users with Security Partners and Lawyers, and is not engaged in Security Services or Security Personnel distributors and is not an Office engaged in Legal Services or Law Firms.
  2. Terms & Conditions are an agreement between the User and the TNOS Application that contains a set of regulations governing the rights, obligations, and responsibilities of users and the TNOS Application, as well as procedures for using the TNOS Application service system.
  3. Service means every service, program, service, product, feature, system, facility, and/or service provided and/or offered in or through the TNOS Application.
  4. Users are parties who access and use the services of the TNOS Application, including downloading the TNOS Application, partners who are members of the TNOS Application, and using the TNOS Application.
  5. Payment Method Providers are any third party, including but not limited to avoiding doubt, both individuals and entities, other parties in the contract, government, or private parties who agree and are selected by PT. Xtreme Network Sistem to support the running of the TNOS Application.
  6. Partners in the TNOS Application are individual personnel and/or companies registered in the TNOS Application who are verified by a third party appointed by PT Xtreme Network Sistem and have expertise in the field of law and security, which do not have a legal working relationship with PT Xtreme Network Sistem and/or the TNOS Application. In addition, the legal relationship between the TNOS Application Partner and the User is the relationship between the service provider and the consumer.
  7. Account, or "Your Account," means a special identification created in the TNOS Application based on your registration request.
  8. Transaction means any transaction, activity, and/or action carried out in or through the Application, Account, and/or Security Code, including the use of certain services or features in the service or application.
  9. Security Assistance Services are assistance services provided by Security Assistance Partners to provide security services in accordance with the security standards set by the TNOS Application.
  10. Legal Assistance Services are assistance services provided by legal partners who are members of the TNOS application to help overcome problems currently being faced by users, especially those related to law, both related to criminal law and civil law or other legal problems.
  11. Legal Consultation Services are consultation services provided by legal partners of the TNOS application for problems related to criminal law, civil law, or other legal problems to users personally through video call facilities.
  12. TNOS Balance is a transaction method that can be used by users to make orders or use services in the TNOS application.
  13. Alert Button is a method in the TNOS Alert Button Application that can provide real-time emergency warnings from users to other users in one application system.


Terms and Conditions means the Terms and/or Conditions, including any changes, additions, replacements, adjustments, and/or modifications that may be adjusted from time to time.


A. Registered Users

  1. By choosing to create an account as a user of the TNOS application, the user will create an account name (username) based on the mobile phone number when completing the registration and verification process that has been set in the TNOS application.
  2. When you open an account, you agree to provide personal information, collection, storage, processing, use, and sharing of your personal information, such as the name, email address, and mobile phone number that you provide. 
  3. The User is responsible for maintaining the confidentiality and security of the username and SMS code or verification email or OTP code (one-time password) and is fully responsible for all activities carried out by or on behalf of the User's account name.
  4. The TNOS Application will not ask for the username or SMS code or verification email or OTP code (one-time password) belonging to the User's account for any reason; therefore, the TNOS Application asks the User not to provide this data or other important data to parties claiming to be the TNOS Application or other parties whose security cannot be guaranteed.
  5. The User understands and agrees that in order to use the OTP security facility, the relevant telecommunications service provider may at any time charge the User a fee in the amount determined by each telecommunications service provider.
  6. The User agrees to immediately notify Us of any suspected unauthorized/invalid use under the name of the registered User account.

 

B. Service Order Transactions

  1. When ordering services, you agree to be responsible for reading, understanding, and agreeing to the information/description of the entire service (including but not limited to photos, quality, partner expertise, and others) before making a booking commitment.
  2. You fully understand and agree that all transactions made other than through the TNOS Application and/or without the knowledge of PT Xtreme Network Sistem Management (through personal facilities/networks, sending messages, or other efforts) are your personal responsibility.
  3. When you want to use the service, you agree that payment must be made by you before the facility can be ordered and/or used.
  4. You make payment using the payment method that you have previously selected, and then we will forward the funds to the partner.
  5. If within a certain time limit the balance/payment value is insufficient, management through the TNOS application has the authority to cancel/stop the transaction in question. You are not entitled to file a claim or demand for the cancellation/termination of the transaction.
  6. You understand and agree that if there are additional costs or those caused by additional duration of use of the service, they are your personal responsibility.
  7. You agree to make payment with the nominal amount according to the bill amount along with the unique code (if any) listed on the payment page.
  8. You can make payments for the services accessed or used through electronic payment methods, provided by the payment method provider on the TNOS application, including electronic money, debit or credit cards, or other payment methods that may change at any time based on our full policy.
  9. To be able to make payments through the Payment Method, you must be officially registered and use your own payment credentials. In the event that you use the registered credentials of another party, you are fully responsible for all necessary permits and all losses or disputes arising between you and the other party.
  10. We have the right to refuse or delay forwarding your payment request via the Payment Method for certain reasons, including but not limited to indications that we have sufficient reasons to suspect fraud, deception, violation of the Terms of Use, violation of applicable laws and regulations, including those related to payment instruments using cards, electronic money, payment transaction processing, anti-money laundering, corruption and prevention of terrorism financing, or other unreasonable or suspicious actions, including failure to fulfill your obligations to us.

 

C. Service Types and Fees

    The types of services available in the TNOS application are as follows:

  1. Security Assistance Services
    1. The nominal cost of security assistance for each classification is different and has been regulated in the TNOS service application. Security Assistance Services are divided into 2 (two), namely:
      1. Classification (A) or Platinum Class.
      2. Classification (C) or Silver Class.
    2. The cost is calculated every 1 hour with a minimum usage of 3 hours.
    3. If assistance is carried out between 22:00 and 05:59, an additional fee is given, the amount of which is determined by the change in user rates in the application.
      1. A. If assistance is carried out on weekends and between 22:00 and 05:59 on that day, an additional fee is given, the amount of which is determined by the change in user rates in the application.
    4. If the security and legal partner completes his task and does not return to his place of origin when the user orders, the cost of returning to the place of origin is borne by the user according to online transportation standards.
  2. Legal Service, divided into 2 (two):
    1. Legal Consultation Services Legal consultation services are carried out through the facilities available in the application, namely via video call, and the cost is calculated according to the duration of use, except if there is a promo from the TNOS application.
      1. The rate is the normal cost, namely consultation carried out during working hours with working hours. If the consultation is carried out between 22:00 and 05:59, an additional fee is charged as specified in the application.
      2. If the consultation is carried out on weekends, an additional fee is charged as specified in the application.
    2.  Legal Assistance Services
      1. Legal Assistance Services are differentiated based on case classification, namely:
        • Assistance in Criminal Law Cases Legal Assistance Partners will provide legal advice on criminal law and civil law or other laws to users and will provide assistance at the examination stage at the police or at the prosecutor's office and, as requested by you, either as a reporter, reported party, witness, or suspect. Assistance is provided so that users can provide information freely and correctly, and the information provided is not fabricated or used to harm the user. As well as guarding the user's legal rights during the examination process to ensure that the examination is carried out in accordance with the laws and regulations and providing advice and/or legal views for the next process.
        • Assistance in Civil Law Cases Legal Assistance Partners will provide legal advice and civil law steps to users to determine the best decision in each problem, including debts, inheritance disputes, marriage, divorce, domestic violence (KDRT), child adoption, land sales, company cases, business agreements, and so on during the assistance.
      2. Calculation of Legal Assistance Services/Services is charged for every 1 (one) assistance.
      3. The rate is a normal fee, namely assistance carried out during working hours with a working time of 4 (four) and 8 (eight) hours in the work area of the Legal Assistance Partner. If the order is made between 22:00 and 05:59, an additional fee will be charged as determined in the application.

      4. The types of services available in the TNOS Application are provided by various partner backgrounds with specific expertise, certification, education, qualifications, and verification by a third party appointed by PT. Xtreme Network Sistem.
      5. The services in the TNOS Application are provided by Partners. You understand that TNOS does not employ Partners and is not responsible for any actions and/or omissions made by Partners.
  3. TNOS Alert Button Application
            This application is designed to be used by anyone and anywhere; anyone from children to the elderly will be able to use the TAB easily, anywhere, and for any emergency situation.

D. Fund Withdrawals

  1. Withdrawals can be made to your account if there is a remaining or excess balance used for service order transactions through the Transaction Menu, then select Your Transaction, then include the Bank Name, Account Number, Name, then click OK, and Submit Refund/Withdrawal of Funds.

  2. You agree and understand that withdrawals of funds at certain times require a certain amount of time so that you are not entitled to file a claim or demand for the period of withdrawal of the balance.

  3. Costs related to withdrawals are the burden and responsibility of the user.

  4. In the event of any alleged violation of the TNOS Application Terms and Conditions, fraud, manipulation, or crime, the User understands and agrees that the TNOS Application has the right to take action to examine, freeze, postpone, and/or cancel the withdrawal of funds made by the User. Examination, freezing, or postponement of withdrawals of funds can be carried out for as long as is necessary by the TNOS Application.

  5. For certain reports related to payment methods, we can refund your funds in a manner determined by us or together with the payment method provider, based on our sole discretion. We will not refund funds to any party other than the registered credentials on the TNOS Account or Payment Method Provider, including if you use another party's credentials to make payments via the Payment Method.


E. Suspension / Blockage / Termination of Service

  • We have the full right to suspend, block, or terminate the service of an account; prohibit access to the TNOS application; freeze, delay, and/or cancel transactions made; and take legal steps to protect users if we consider that the registered violates applicable laws, violates the intellectual property rights of related parties, commits fraud, or commits a violation of the matters stated in this agreement.

  • Users are not permitted to sell, attempt to sell, offer to sell, give, submit, or transfer accounts or user identities to third parties without our prior knowledge and written consent. We may suspend or terminate the user's account or the account of the party receiving the transfer from the user who is sold, offered for sale, given, submitted, or transferred in violation of these provisions. If with our limited ability to identify this violation, then all consequences and risks are the responsibility of the registered user who transferred.

  • Users intentionally hack the TNOS application, which can harm PT Xtreme Network Sistem Management and other users.

  • Users use customer relationship management services only for something that is not appropriate, such as:

  • Spamming Message in Live chat.
  • Submitting questions outside the TNOS application.
  • Terrorizing TNOS Customer Relationship Management officers.
  • Making rude statements.
  • And so on, so as to disrupt customer relationship services.
  1. By performing the Termination of Service, the User automatically:
    • Declares that he/she is releasing his/her right to make demands, lawsuits, bills, reports, and/or complaints against the management of PT Xtreme Network Sistem related to this termination of service.
    • Declares that he/she is releasing the remaining balance that is still left and not taken.
    • Releases/separates all forms of appreciation for the TNOS Application Service program.

F. Force Majeure

The TNOS Application may be interrupted by events beyond Our authority or control (“Force Majeure”), including but not limited to natural disasters, government policies, riots, wars and others. You agree to release Us from any claims and responsibilities, if We are unable to facilitate the Services, including fulfilling instructions You provide through this Application, either in part or in whole, due to a Force Majeure Event.


G. Intellectual Property Rights

We are the sole owner or legal holder of all rights to and content in the TNOS Application, including intellectual property rights protected by copyright laws and other laws protecting intellectual property in force in the Republic of Indonesia. All ownership rights and intellectual property rights to the TNOS Application and its contents remain with us, its affiliates, or the TNOS Application content license owners. All rights not expressly stated in this Agreement or by Us are hereby reserved. The TNOS Application, its name, and related icons and logos are registered trademarks in various jurisdictions and are protected by copyright, trademark, or other intellectual property laws. It is strictly prohibited to use, modify, or install the above brands on any media without our consent.


H. Updates to Terms and Conditions

We reserve the right to change our Terms and Conditions at any time. Please check our Terms and Conditions periodically for changes. If you continue to use our services after the changes become effective, we will assume that you agree and are willing to be bound to accept all changes made to these Terms and Conditions.


I. Problem and Dispute Resolution

If you experience any problems or issues related to the service or payment method provider, you can submit your complaint by contacting us via email at customerservice@tnos.world or by phone at (+62) 8119 5954 93. All your correspondence will be recorded and stored for our archives.

To submit a complaint, question, objection, etc. (“Report”), you need to provide sufficient information, including but not limited to a summary of the facts that occurred, the evidence you have, the order number, and personal information, such as your registered email address and mobile phone number.

To respond to each report you submit, we will first verify by matching the information you provide and your personal information contained in our system. If necessary, we may directly ask you to provide the information required for verification purposes.

We may refuse to follow up on your report if the information you provide does not match the personal information contained in our system or if the report is submitted in relation to, against, on behalf of, or by another party different from the owner of the relevant account officially registered in our system. We may stop following up on your report if we consider that your report is not supported by sufficient and clear facts or has been completed. We may also forward your report to the service provider or payment method provider to be resolved directly by you and the service provider or payment method provider.

For certain reports related to the service, we may, at our sole discretion, facilitate a meeting between you and the third-party service provider for the purpose of resolving the problem peacefully and amicably. In such a case, if You feel that You still need to take other actions, including any legal action, You may do so at Your sole responsibility.

We will follow up by conducting an investigation and/or facilitating the relevant service provider to report to the authorities if we receive a report of a violation by you of these Terms of Use or a violation of applicable laws and regulations.

This provision applies vice versa when you experience the same thing mentioned above by a third-party service provider.


J. Problem and Dispute Resolution

  1. We provide the application as is, and we do not represent or warrant that the reliability, timeliness, quality, suitability, availability, accuracy, completeness, or security of the application will meet your needs and will meet your expectations, including but not limited to the services and payment methods, which are entirely the responsibility of the service provider and payment method provider. We are not responsible for any loss or damage caused by any failure or error made by the Service Provider or Payment Method Provider or your failure or error in complying with our Terms of Use, the Service Provider, or the Payment Method Provider.
  2. The application may experience limitations, delays, and other problems inherent in the use of the internet and other electronic communications, including your device, the service provider, or the payment method provider being damaged, not connected to the internet, out of range, turned off, or not functioning. We are not responsible for any delays, failures of delivery, damage, or loss resulting from such problems.
  3. We are not obligated to monitor your access to or use of the application. However, we continue to monitor for the purpose of ensuring smooth use of the application and to ensure compliance with these Terms of Use, applicable laws and regulations, court decisions, and/or provisions of administrative institutions or other government bodies.

    We have no obligation whatsoever, including to take further action or legal action deemed necessary by you, the Service Provider, or the Payment Method Provider, regarding any problem or dispute arising between you and the Service Provider, or the Payment Method Provider. However, We will facilitate any problem or dispute arising between you and the Service Provider, Payment Method Provider with reasonable efforts required. When We facilitate the resolution of a problem or dispute between you and the Service Provider, or the Payment Method Provider, We do not act as a mediator and this does not create any further obligations for Us.


K. Others

    

    You can contact us through the facilities provided by the TNOS application. All your correspondence will be recorded and stored for our archives.
