TNOS TERMS OF USE

 

The following determines the Terms of Service Agreement between the ‘User’s’ (You) as the one who uses the TNOS App’s services and PT. Xtreme Network Sistem (Us)  as the one who maintains the TNOS App, which contains the terms and conditions for the usage of TNOS App that are applied for User’s in order to use our services.

Please read this User’s Agreement carefully as User’s must first read, understand, accept, and agree to all of the terms and conditions in this agreement before continuing further use of the application and/or receiving further contents within the app.

By using the app and/or resuming access within the TNOS App. User’s agrees and acknowledges all of the terms and conditions provided. TNOS App as an app, which the User’s him/herself has downloaded and led to this Terms of Service page, is now acknowledged as a brand, logo and/or a symbol, as well with the name TNOS.

User’s also acknowledges and agrees that the Terms of Service as an agreement is electronic-based and as User’s has clicked the “Sign Up” button when opening an account or clicked the “Log In” button when accessing account will be received as an active agreement from the User’s whom him/herself will be bound with our Terms of Service. Furthermore, this would also serve as the legitimacy of this Terms of Service along with our Privacy Policy which is confirmed and will be legally bound towards the User’s as well also be valid throughout the User’s usage of the TNOS App services.

Should User’s choose not to agree or accept one, some, or all of the terms and conditions within this agreement, User’s will be denied further access into the app. 

 

DEFINITION

 

  1. PT. Xtreme Network Sistem is a limited company which owns the TNOS brand, legally founded and operating within the laws of Republic of Indonesia, domiciled in Special Capital District of Jakarta, Indonesia. PT. Xtreme Network Sistem is a software technology company which provides an online-based application service and not a Security Escort Partners Firm, as well as neither a Legal service provider or a  Law Firm.
  2. Terms and conditions are the agreements between User’s with TNOS which contain sets of rules that govern the rights, obligations, and the responsibilities both User’s and TNOS, also along with procedures for the use of the service system in TNOS.
  3. Service is the product, feature, system, facility, and/or the service which is available and/or offered within or through the TNOS App.
  4. User’s is identified as the one who access and use the TNOS service, which includes downloading the TNOS app, or Partner incorporated in TNOS, and using the TNOS app itself.
  5. Payment Method Provider is identified and provided by any Third-Parties, including but not limited in order to avoid any hesitation, whether for individuals or entities, other parties in the contract, the government, or private sectors who agreed and selected by PT. Extreme Network Sistem in favor of supporting the running of TNOS App.
  6. Partners to the TNOS App are identified as the individual personnel, registered within the app along with an account, with proficiency at Law and Security in which do not have any legal bound or relations with TNOS and/or TNOS App. Moreover, legal relations between Partner and User’s is the exclusive relation between the service provider and consumer.
  7. Account or “Your Account” implies the special identification which is made and based on the request of your registration in the TNOS App.
  8. Transaction implies any kind of transactions, activities, and/or actions made within or through the App, Account and/or Security Code including the usage of service or other certain features in the App.
  9. Security Escort Service identifies as the escort service which is provided by Security Escort Partners in order to offer security services that also correspond with the security standards set by TNOS.
  10. Legal Advisory Service as provided by Law Partners in favor of assisting User’s legal problems, whether it’s Criminal Law and Civil Law, or any legal issues.
  11. Law Consulting Service as provided by Law Partners regarding Criminal Law, Civil Law, or any legal issues which consultations are held privately with User’s through Video Call.

 

TNOS APP 

TERMS AND CONDITIONS

 

Terms and Conditions below set forth any changes, additions, replacements, adjustments, and/or modifications which are subject to adapt from time to time.

 

A. Registered User’s

  1. By choosing to register an account as User’s of TNOS App. User’ss will create a username based on their mobile phone number when completing the registration process as well as the verifications which are set in the TNOS App.  
  2. When opening an account, User’s agrees to give their Personal Information, which includes collecting, storing, processing, using, and sharing User’s personal information, such as name, e-mail address, and mobile phone number which he/she provided.
  3. User’s is responsible to keep the confidentiality and the security over the username and the verification code SMS or OTP Code (One Time Password), as well as the responsibility over every activity which are done under the name of the User’s account.
  4. TNOS will not ask for username nor verification code SMS or OTP code for any kind of reasons, therefore TNOS requests User’s not to provide such data or other essential data to anyone even to TNOS or any other suspicious parties.
  5. User’s acknowledges and agrees that in order to use OTP security service, communication service providers which are related to User’s can at any time charge rates toward User’ss with the nominals that have already been set by each communication service provider.
  6. User’s agrees to immediately notify us for any types of unvalid and suspicious activity in which the User’s account has been used without his/her knowledge or consent.

 

B. Service Order Transactions

  1. When ordering service, User’s agrees the responsibility to read, understand, and approve all of the service’s information/description (along within including but not limited to the photo, quality, Partner’s expertise, and others) before making commitment towards the order.
  2. User’s fully understands and agrees that all of the transactions done outside of TNOS App and/or without the knowledge of the TNOS Management (through private network/facility, message delivery, or other efforts) is at the User’s own responsibility.
  3. When using the service, User’s agrees that payment efforts must be done before User’s can order or use the facility.
  4. User’s makes payment through using the payment method which has already been selected by the User’s, and then TNOS will forward the funds to the Partner.
  5. If the Payment balance is insufficient within a certain amount of time then TNOS Management has the authority to cancel/terminate the aforementioned transaction. User’s has no right to file a claim or demand over the cancelation/termination.
  6. User’s acknowledges and agrees that if additional fees applied or at the cause of the additional time duration of using the service are at the personal responsibility of the User’s.
  7. User’s agrees to make payments with the nominal that is appropriate with the amount of the bill along with a unique code (if there are) which is printed on the payment page.
  8. User’s is able to make payments to the service which is accessed or used through electronic payment method, that is provided by Payment Method Providers to TNOS App, include as well with electric money (e-money), debit or credit card, or other payment methods which time to time subject to change in fully favor of our policy.
  9. In order to purchase through the payment method. User’s must be officially registered and use the User’s own payment credentials. In the event of the User’s own use of another party’s registered credential, User’s is fully responsible over all of the required agreement as well as the loss or dispute arose between the User’s and that other party.
  10. We have the rights to refuse or postpone of forwarding User’s payment request through the payment method for certain reasons, including but not limited to any indication or We have the sufficient reasons to suspect any fraud, deceit, violation against the Terms of Use, violations towards the laws regarding payments using cards, electric money, payment transaction processes, anti-money laundering, corruption, and terrorism financing, or any unusual or suspicious behaviour, including any obligations User’s has yet to fulfill to Us.

 

 

C. Service Types and Fees

Types of available service within TNOS App are as followed:

  1. Security Escort Service
    1. Nominal fees for Security Escort Service are each distinctive in classification as well have been set out in TNOS service app. Security Escort Services are divided into 2 (two) classification:
      1. Classification (A) or Platinum Class.
      2. Classification (C) or Silver Class.
    2. Fees are charged every 1 hour with minimum hour usage of 3 hours.
    3. Purchase of packages that come in 2 shifts with different conditions (Normal and Night) then the rate applies prorated.
    4. If escort services being made between 22.00 until 05.59, shall further be charged with additional cost specified within the app.
      • If escort services being made on weekend, shall further be charged with additional cost specified within the app.
      • If escort services being made on a national holiday, shall further be charged with additional cost specified within the app.
    5. User’s who cancels order when Security Escort Partner is already on the way to Member’s location then shall be charged with fees to the User’s.
    6. If the Security Escort Partner complete his duties and does not return to his original place of duty, at the time the User’s places an order, the cost of returning to his place of origin is borne by the User’s according to online transportation standarts.
  2. Legal Service, divided into 2 (two):
    1. Legal Consultation Service
      Legal Consultation Service is carried out through the provided facilities within the App which is Video Call and will be charged according to duration of use.
      • The rates are normal costs, namely Consultations carried out during working hours with working hours. If the Consultation is carried out between the hours of 22.00 to 05.59 an additional fee is charged as specified in the application.
      • If the Consultation is conducted on a weekend subject to additional fees specified in the application.
      • If the Consultation is conducted on a public holiday, an additional fee will be charged as specified in the application.
    2. Legal Assistance Service
      • Legal Assistance services are divided based on the case classification:
        • Assistance in Criminal Law case
          Legal Assistance Partner will give legal advice regarding Criminal Law for User’s as well as conduct assistance during the inspection stage in the Police and the Attorney General’s Office, whether as Plaintiff, Defendant, Witness and Suspect.
          Assistance is made in order for the User’s to be able to provide information freely and correctly while the information given is not fabricated nor used to do harm to the User’s self. As well as guarding the legal rights of User’s in the inspection process to ensure the examination is being conducted in accordance with the Laws and Regulations and further give advice and/or legal view for further proceedings.
        • Assistance in Civil Law case
          Legal Assistance Partner will give legal advice and Civil Law guidelines for User’s in order to determine the best option in each affairs regarding debts and receivables, inheritance dispute, marriage, divorce, domestic violence, child adoption, real estate, corporate case, business deal, and others during the assistance.
      • Legal Assistance Service fees shall be charged for each 1 (one) Assistance. 
      • The tariffs are normal fees, which assistance is being made during work hours at the maximum of 8 work hours of the Legal Assistance Partner’s part. If orders being made between 22.00 until 05.59 shall further be charged with additional cost specified within the app.
        • The tariffs are normal fees, which assistance is being made during work hours at the maximum of 8 work hours of the Legal Assistance Partner’s part. If orders being made on weekend shall further be charged with additional cost specified within the app.
        • The tariffs are normal fees, which assistance is being made during work hours at the maximum of 8 work hours of the Legal Assistance Partner’s part. If orders being made on a national holiday shall further be charged with additional cost specified within the app.
      • User’s who cancels order when Legal Assistance Partner is already on the way to User’s location then shall be charged with fees to the User’s.

The types of services available in TNOS App are provided by the variety of backgrounds of the Partners with expertise, certification, education, specific qualification, and verification from the Third Party chosen by PT. Xtreme Network Sistem.

Services displayed within the TNOS App are provided by the Partners, in which the Partners have gone through the registration process so that You understand that TNOS did not employ the Partners as well as not responsible for any actions and/or negligence done by the Partners.


D. Fund Withdrawals

  1. Withdrawal of funds can be made by User’s if there is a remaining or excessing balance used for service order transactions.

  2. User’s agrees and understands funds withdrawal in certain times may take time so that User’s do not have the right to file claims or demands for the period of time of the withdrawals.

  3. Charged fees regarding withdrawal of funds are at the cost of the User’s.

  4. In the event of alleged violations are discovered towards the TNOS Terms and Conditions, fraud, manipulation, or crime, User’s understands and agrees that TNOS have the right to carry out inspection, freezement, postponement, and/or cancellation of the fund withdrawals made by User’s. Inspection, freezement, or postponement of fund withdrawals can be done in the period of time as needed by TNOS.


E. Suspension / Blockage / Termination of Service

  • We have the fully rights to suspend, block, or end the service from an account, denying access to TNOS App, carrying out freezement, postponement and/or cancellation towards made transactions and taking legal steps  in order to contain registered User’s if We consider User’s to be in violation of applicable laws, violation of intellectual property rights from related parties, cheating (fraud) or committed violation against the things that are stated in this Agreement.

  • User’s are not allowed to sell, attempt to sell, offer to sell, give, turn over, or divert Accounts, User’s IDs to Third-parties without the written knowledge and approval prior from Us. We are allowed to suspend or cease registered User’s accounts or accounts of the party which received diversion from User’s that are sold, offered to sell, given, submitted, or diverted by violating these conditions. If Our limited ability affects the identifying violation, then all of the consequences and risks are at the responsibility of the registered User’s who diverted.

  • Intentional hacking of TNOS App by User’s which can be detrimental towards TNOS Management and other User’s.

  • User’s using Customer Support service with the purposes that are not intended for, such as:

  • Spamming Message in Live chat.
  • Asking questions outside the realm of TNOS.
  • Committing terrors towards TNOS Customer Support Officers.
  • Blurting out abrasive/abusive statement.
  • Among others which disturbed Customer Support service.
  1. By doing termination of service, Users automatically :
    • To state the relinquishing of their rights in making claims, suits, bills, reports, and complaints against.
    • To state the letting go the rest of their untaken balance.
    • To release/separate all forms of appreciation of TNOS service program.

F. Force Majeure

TNOS Application may be able to be interrupted by circumstances outside the nature of Our authority and control (“Force Majeure”), including but not limited to natural disasters, government policy, riot, warfare, and others. You agree to release Us from every claim and responsibility, if We cannot facilitate including fulfilling Your instruction given through this App partly or entirely, in regards of a Force Majeure


G. Intellectual Property Rights

We are the sole owner or legal holder of all the rights and the contents in TNOS App, includes intellectual property rights which are under Republik Indonesia copyright laws and other laws protecting intellectual property. All of the ownership rights and intellectual rights over TNOS App and the contents remain with us, its affiliates or intellectual licensees. All of the rights that are not listed within this Agreement or by Us are hereby protected under the laws. TNOS App, name and icon as well as related logos are registered trademarks in various jurisdictions and are protected under the laws regarding copyright, trademark, or other intellectual property rights. It is strictly prohibited to use, change, or apply the above-mentioned brand on any media without our full agreement.


H. Terms and Conditions Renewals

We have the right to change Our Terms and Conditions at certain times. Please periodically check the Terms and Conditions to keep up to date with changes that occur.

If You continue to use our service after the changes become effective, then We consider that You agree and are willing to bind yourself to accept every single change occurred within this Terms and Conditions.


I. Miscellaneous

You can contact us through the facilities provided by TNOS. All of your correspondence will be noted down, recorded, and saved into our archives.
